INFORMATION PROVIDED TO DATA SUBJECTS ON THE PROCESSING OF PERSONAL DATA AND INFORMATION ON RIGHTS

Tieto informácie poskytované dotknutým osobám pri spracúvaní osobných údajov a poučenie o právach sú neoddeliteľnou súčasťou všeobecných obchodných podmienok obchodnej spoločnosti TESMAR s.r.o., so sídlom Solivarská 125/11, 821 03 Bratislava – mestská časť Ružinov, Slovenská republika, IČO: 45 602 531, DIČ: SK2023074196, IČ DPH: SK SK2023074196, zapísanej v Obchodnom registri Okresného súdu Bratislava I, oddiel Sro, vložka č. 143293/B („prevádzkovateľ“). Prevádzkovateľ ako predávajúci v súvislosti so spracúvaním osobných údajov kupujúcich („dotknuté osoby“) týmto v súlade s § 19 zákona č. 18/2018 Z. z. o ochrane osobných údajov poskytuje dotknutým osobám nasledovné informácie:

1. Prevádzkovateľom informačného systému je obchodná spoločnosť TESMAR s.r.o., so sídlom Solivarská 125/11, 821 03 Bratislava – mestská časť Ružinov, Slovenská republika, IČO: 45 602 531, DIČ: SK2023074196, IČ DPH: SK SK2023074196, zapísaná v Obchodnom registri Okresného súdu Bratislava I, oddiel Sro, vložka č. 143293/B. Dotknutá osoba môže prevádzkovateľa kontaktovať na adrese sídla alebo na emailovej adrese : info@wpcplastic.sk
2. The controller processes the personal data of the data subject for the purpose of the offer of goods and the subsequent conclusion and performance of the purchase contract between the controller and the data subject and the provision of related services.
3. The controller also processes personal data for the purpose of sending newsletters and promotional e-mails (direct marketing) regarding the controller's own goods and services similar to the goods that the data subject has already purchased and the services that have been provided to him or her, via the online shop on the website https://wpcplastic.sk within the meaning of Section 62(3) of Act No. 351/2011 Coll. on electronic communications, as amended. The data subject shall be entitled to refuse the sending of newsletters and promotional emails at any time, free of charge, either via a web link accessible in each newsletter or promotional email or via an email message sent to the email address: info@wpcplastic.sk In the case of sending marketing communications about goods and services other than the controller's own similar goods and services, the controller shall request consent to the processing of personal data.
4. The legal basis for the processing of the data subject's personal data is the performance of measures prior to the conclusion of the purchase contract on the basis of the data subject's request and the purchase contract, since the processing of the data subject's personal data is necessary for the performance of the purchase contract.
5. Právnym základom spracúvania osobných údajov dotknutej osoby v prípade zasielania newsletterov a propagačných e-mailov (priamy marketing) je oprávnený záujem prevádzkovateľa v zmysle § 13 ods. 1 písm. f) zákona o ochrane osobných údajov, ktorým je ďalšia ponuka vlastných podobných tovarov a služieb prevádzkovateľa dotknutej osobe. Pri zasielaní marketingových oznámení o iných ako vlastných podobných tovaroch a službách prevádzkovateľa je právnym základom spracúvania osobných údajov dotknutej osoby súhlas dotknutej osoby v zmysle § 13 ods. 1 písm. a) zákona o ochrane osobných údajov, ktorý je oprávnená osoba oprávnená kedykoľvek odvolať.
6. The personal data of the data subject shall not be disclosed to recipients except in cases expressly provided for in generally binding legal regulations (§ 5 (q) of the Personal Data Protection Act). The personal data of the data subject may be disclosed to auditors, tax, legal or other advisors and entities which have a legal right to disclose such data. To the extent strictly necessary to fulfil the purpose of the processing of personal data, the personal data of the data subject may also be disclosed to other persons, such as the website administrator, server administrator, external subcontractors, mail carriers, etc. Personal data will not be transferred to a third country (§ 5 (ab) of the Data Protection Act) or an international organisation (§ 5 (z) of the Data Protection Act);
7. The operator shall keep the personal data of the data subject for a period of 5 (five) years from the conclusion of the last purchase contract between the controller and the data subject and, if no purchase contract has been concluded, for a period of 3 (three) years from the date of their disclosure to the controller.
8. The data subject has the right to obtain confirmation from the controller as to whether personal data relating to him or her are being processed and has the right to access the data and information pursuant to Section 21 of the Personal Data Protection Act.
9. The data subject shall have the right to rectification of incorrect personal data concerning him or her and, having regard to the purpose of the processing, the data subject shall have the right to the completion of incomplete personal data.
10. The data subject shall have the right to erasure of personal data concerning him or her under the conditions set out in Section 23 of the Personal Data Protection Act.
11. The data subject has the right to restrict the processing of personal data under the conditions set out in Section 24 of the Personal Data Protection Act.
12. The data subject shall have the right, under the conditions laid down in Section 26 of the Personal Data Protection Act, to obtain the personal data concerning him or her which he or she has provided to the controller in a structured, commonly used and machine-readable format, and shall have the right to transfer such personal data to another controller, if technically possible.
13.Dotknutá osoba má právo podať návrh na začatie konania o ochrane osobných údajov pred Úradom na ochranu osobných údajov podľa § 100 zákona o ochrane osobných údajov.
14. Where the rectification, erasure or restriction of the processing of personal data of the data subject has been effected by the controller, the controller shall communicate such rectification, erasure or restriction of the processing of personal data to each recipient, unless this proves impossible or requires disproportionate effort. The controller shall inform the data subject of the recipients only if the data subject so requests.
15. The provision of the data subject's personal data is a necessary requirement for the conclusion and performance of the purchase contract and the provision of related services.

Pursuant to Section 27(3) of the Personal Data Protection Act, the controller expressly informs the data subject of the right to object to the processing of personal data on grounds relating to his or her particular situation carried out pursuant to Section 13(1)(e) or (f) of the Personal Data Protection Act, including profiling based on these provisions, and for the purpose of direct marketing, including profiling to the extent that it is related to direct marketing.
